SELANGOR SULTAN AND CONFERENCE OF RULERS NEED TO EXPLAIN TO RAKYAT ABOUT APPOINTMENTS OF MBs and PRIME MINISTERS

PLEASE EXPLAIN WHAT WAS THE CONSTITUTIONAL CONVENTION IN THE APPOINTMENT OF PRIME MINISTERS AND MENTERI BESARS  FROM THE DAY MALAYSIA BECAME  A CONSTITUTIONAL MONARCHY?

Constitutional law expert professor Abdul Aziz Bari has urged the palace to explain the previous practice of  appointing a menteri besar.
 
He said the palace should explain the practice since 1959 when the country had a constitutional monarchy.

The palace should also make clear its views on requirements for majority and submission of names.
 
“Is it similar to what we understand, (which is) what has been practised throughout the commonwealth, or something different?” he asked.
 
He also asked for the palace’s views on the Selangor constitution’s requirement that the menteri besar must be a Malay and a Muslim, since it had become an issue during the 1969 general election.
 
“It has to be pointed out that a practice - past and present - may not be right and in conformity with (the) constitution, which embody the practice of Westminster democracy convention in this respect.
 
“Let us take the opportunity to put the law and practice straight and clear, so that in future there will be no more delay like what happened in Selangor,” he said yesterday.
 

 Yesterday, the Sultan of Selangor’s private secretary Mohamad Munir Bani  ) denied Anwar’s claims that it is the convention since independence to nominate only one person for the post of menteri besar.

In response, Anwar said
 “I merely wanted to state what had happened within my knowledge, especially while I was in the Umno-BN government from 1982 to 1998.If I had erred, I wish to apologise to his highness the sultan of Selangor.”
 
In addition, Aziz Bari suggested that the CONFERENCE OF RULERS  and the NATIONAL PALACE  should also  EXPLAIN  how the appointments of prime ministers are carried out.

He said this as the legal provisions for the appointment for menteri besar and those for the appointment of prime ministers are “ESSENTIALLY THE SAME".
 
“The National Palace should tell us how PRIME MINISTERS HAVE BEEN APPOINTED  and how changes during the term or after general election (are) normally being handled,” he said.\

Photo: The Selangor palace has reportedly interviewed three candidates for it to select the Selangor menteri besar, but the candidates appear to EXCLUDE  PAKATAN's AGREED CHOICE.

PKR president Wan Azizah Wan Ismail, who was decided upon after a Pakatan leadership meeting on Aug 17 was not amongst those called up for the said interviews.

The Star Online's report today named PAS executive councillors Iskandar Samad (left) and Dr Ahmad Yunus Hairi and PKR deputy president Azmin Ali as the three who attended what The Star called "interviews" to determine the MB.

Quoting unnamed sources, the report said the meetings were conducted individually over the past week.

On Thursday it was reported that the palace will swear in the MB on Tuesday, and has sent out invitations to the ceremony despite Pakatan Rakyat leaders claiming to be in the dark.

According to The Star, among those in the MB post “interview panel” were state secretary Mohamed Khusrin Munawi, state legal adviser Nik Suhaimi Nik Sulaiman and two royal council members.

It also reported PKR de facto leader Anwar Ibrahim accepting the news when Azmin purportedly informed him of the matter on Thursday.

However a PKR source today said the party has not agreed with Azmin's appointment, only that the eventuality has been considered.

The party is said to remain steadfast on their choice of Wan Azizah.

Meanwhile PKR-linked NGO Jingga 13 Selangor is continuing to voice support for Wan Azizah, appealing to the Selangor sultan to elect her as she has the support of the state assembly majority.

"As a NGO and as Selangor citizens who defend the royal instution and constitution, and who love Selangor, we hope the prolonged MB crisis will be settled quickly...

"We believe based on article 53(2)(a) of the Selangor constitution the sultan ought to appoint someone whom he is confident has the support of the majority of the state assembly.

"Precisely what methodology the tuanku employs, we are confident his highness will not contravene article 53(2)(a)..." said Jingga 13 national deputy secretary Afzainizam Abdul Rahman in a statement today.

He said the NGO hopes the sultan will exercise wisdom to end the saga by appoint Wan Azizah as the MB so that the state can continue to prosper.

"We call on all Selangorians to be patient and not raise all kinds of perceptions and polemic that can disrupt the harmony of the state that we all love," he added.
